Research Project Part 1
As the daughter of immigrant parents, the issue of Immigration and Migration is very interesting and
important to me. Reasons that force people to migrate are many, but the way in which our laws protect
and assist immigrant families are in some cases crucial for their survival and betterment.
In the United States, the tree branches of government have a different role and duty on the way the laws
are drafted, implemented and upheld. As the Executive, Legislative and Judicial branches have a
perfectly defined capacity in the way in which our laws are drafted, carried out and reviewed (Judicial
Branch, n.d.).
The President and Vice President, who are the Executive branch of government together with their
cabinets and advisors, are noted by their job of carrying out and enforcing the countries’ laws or
implementing them.
Immigration Laws are defined by the U. S. Constitution. As Ms. Jennifer Chacon indicates in her article
Who is Responsible for U.S. immigration policy? of the American Bar Association. She states that the
legislative branch of government is responsible for establishing and making the laws:
Article I, Section 8, clause 4 of the Constitution entrusts the federal legislative branch with the
power to “establish an uniform Rule of Naturalization.” This clear textual command for uniformity
establishes that the federal government, specifically Congress, is responsible for crafting the laws
that determine how and when noncitizens can become nat-uralized citizens of the United States.
It is diffidently the role of the Supreme Court, the Judicial branch of government, to review the intention of
the law and how they are implemented or applied. They are a way for the legislative and executive
branches of governments to be kept in check (Judicial Branch, n.d.). The legislative branch of
government also decide on cases that require their introversion to decide on the meaning of laws and
how the same are used in these cases. They ensure that the laws do not violate the constitution, and as
Chacon says, that they “articulate clear limits on state immigration powers and ensure that the proper
implementation does not break the rights of people and government (Chacon, 2014).
