One of the major methods of solving crimes is through interrogations and confessions.
Unfortunately, the downfall of confessions obtained from interrogations sometimes result in
problems for police, criminals, and the courts. The issue is that many of these confessions are
coerced. While police have an obligation to the public to solve crimes, they are adapting clever
tactics as a mean of obtaining confessions in the interrogation room. Although confessions are
supposed to be voluntary and free of coercion, police in many states have manage ways to
bypass laws enacted to guard against such tactics, and violate due process of individuals they are
The Fourteen Amendment?s due process clause, the Fifth Amendment?s privilege against selfincrimination, and the Sixth Amendment?s right to counsel (Hemmens, 2014 p:21) ensure that
citizens are protected, but citizens? rights are still being violated today. The ramifications of
coerced false confessions results in innocent people being convicted and given long sentences. It
is reported that teen-agers and mentally challenged individuals are more likely to be victims of
false confessions (2014, p:22).
According to Balco (2017) of the Washington Post https://www.washingtonpost.com/news/thewatch/wp/2017/03/10/big-changes-may-be-coming-to-police-interrogations/ false confessions
are more common than people think, and most confessions are based on the ability of the police
to wear suspect down suspects. Police use all types of methods designed to get a confession
from suspects. One method that I observed through documentaries is playing one suspect against
another. One suspect is told by police that the other suspect confessed believing that they will get
a confession from one or both of the suspects.
Living in Mississippi leaves me to believe that little change has been made in spite of the laws
enacted to protect Citizens. Mississippi has a history of violating the rights of minorities through
the interrogation process. As a result, it is believed that many of the inmates confined in
Mississippi prisons are innocent. Many minoritties due process are still being violated, and they
are force to confess and take pleas to avoid long sentences. A land mark case that brought about
rules of confessions was Brown v Mississippi (1936) where Brown, an African American was
convicted of murder and sentenced to death based on a coerced confection as a result of torture
(Israel, Kamisar, LaFave, King, & Primus, 2016 p:280). The case was overturned by the United
States Supreme Court which prohibited torture as a mean of obtaining a confession (2016).
