Collaboration between port security and law enforcement operations is critical if
both entities want to interact operationally. Although the jurisdictions still remain the same, the
port FSO generally has jurisdiction over the respective port. Whereas, the law enforcement
authorities have jurisdiction over their prescribed geographic area. But, seeing as how a port
belongs (or is at least geographically located in) a city or county, then it can easily get confusing.
There is simply no room for more confusion in an already extremely complex port environment.
To properly combat this problem, once again the key is communication. Communication
between the heads of each agency and having a collaborative working relationship is crucial to
smooth and effective port operations. The Chief of Police of the local law enforcement agency
must be able to speak freely and frequently with the Port FSO. It?s easy to contemplate the need
for having both agencies, but, it?s not the pure simplicity of having more personnel to protect the
port. There are legalities as well that impact how both agencies work and collaborate. For
instance, not all violations fall into the realm of the port FSO. In many cases, the situation must
be handled by local law enforcement authorities. Yes, the port security personnel can initially
apprehend, but, the specific violations may require the handling of the situation by local, state, or
federal law enforcement personnel. This is yet another reason why the two departments should
be able to work together in unison as opposed to working against each other. For instance, the
local police should always be included in any facility security plan that addresses matters related
to administration, legal authority to act, training, joint training and exercise functions and
activities, and response and recovery from a natural or manmade disaster or terrorist attack.
Together, both parties can work in harmony and establish a secure and safe port (Christopher
2015).

In 2013, the Director of National Intelligence (DNI), James Clapper released the
annual Worldwide Threat Assessment of the US Intelligence Community. In this document,
Clapper outlined ??how quickly and radically the world?and our threat environment?are
changing? (2013, p. ii). ±he report also indicated what the DNI thought were the most urgent
priorities in threats to the nation. ±he threats were broken down into global and regional threats.
The number one global threat was Cyber, and he defined the threat as cyber-attacks and cyberespionage. He expressed concerns over state actors, in particular China and Russia, non-state
actors, terrorists, criminals, and hackers and the damage that a successful a²ack may cause. He
also expressed doubt that we are prepared to meet ??new and unpredictable cyber threats?

The collaborations between port security and law enforcement operations requires both agencies
to work together in order to develop a strategic plan that can provide maximum security at the
specified port location upon assessing current threats presented at once geographical
location. Christopher (2015) describes, ?collaboration with local planners, businesses,
community groups and officials is necessary in developing a strategy for effective policing, a
security organization taking into consideration the target environment?s relative strengths and
weaknesses for management of identified risks (p. 299). The terrorist attack on September 11,
2001, presented critical vulnerabilities and weaknesses in the overall security posture of the
United States, requiring immediate modifications to both private sector security and law
enforcement agencies in order to establish better security protocols, sharing sensitive yet
pertinent information between agencies, and in efforts to work together in establishing a unified
partnership to maintain operational security at the 360 port locations comprised within the
United States (Christopher, p.316, 2015). As a result of the HSPD-8 emphasized establishing a
national policy to strengthen the preparedness of the US to prevent and respond to acts of
terrorism, jointly incorporating law enforcement agencies into updated port security
technologies. It is critical that port security and law enforcement work together to ensure the
proper security is provided to the port, with the overall jurisdictions belonging to the Port FSO
(Christopher, 2015). As, local law enforcement jurisdiction falls with the areas located around
the port, however in some incidences both jurisdiction may overlap, thus the importance of a
unified partnership with each other. In efforts of maximizing security efforts and prevent
redundancy, keeping a two way communication flow, the FSO and law enforcement (Sheriff or
Chief of Police) should have a clear understanding of zoning, and threat reaction plans to ensure
manpower is trained accordingly. Additionally, combined training with both port security staff
and law enforcement agencies will build stronger relationship and establish unit cohesion
focusing on the overall goal of safeguarding our maritime port locations. Lastly, Christopher
(2015) stated, “the MTSA established additional security parameters for seaports, requiring that
vulnerability assessment at U.S. seaports be conducted to determine the nature and type of threat
or risks for each particular port facility, mandating ports develop Facility Security Plans (FSPs)
to mitigate such threats” (Christopher, p319, 2015). Port Security managers should strive to
maximize a collaborative, systemic approach to port security through developing cooperative
leadership between all agencies providing security, ensuring reliable communications between
stakeholders, as well as identifying appropriate security technologies and methods
incorporating federal and state port security regulations into FSPs.
